Terms of Service

These terms are a draft and should be reviewed by counsel before public launch.

These terms are an agreement between you and OpenSeat LLC ("Open Seat", "we", "us"). By creating an account or using Open Seat, you agree to them and to the Privacy Policy.

Who can use Open Seat

  • You must be 18 or older. Your birthdate is set once and can't be changed later.
  • One account per person. Use your real first name, your own photos, and accurate information.
  • You can't use Open Seat if we've previously removed your account, or if the law doesn't allow you to.

What Open Seat is, and what it isn't

  • Open Seat helps adults meet for meals at restaurants: open a table, ask for a seat at someone else's, and meet there.
  • We don't run restaurants, take reservations, sell food, or handle payments. The bill is settled at the table the way the host described it: split evenly, or everyone pays their own.
  • Restaurant details come largely from OpenStreetMap and can be out of date. Check hours, menus, and prices with the restaurant.
  • We don't run criminal background checks. Badges say exactly what was checked (a confirmed phone, a photo check, or an ID check through Stripe Identity), never that someone is safe.

Meeting people

You're responsible for your own decisions and safety when you meet people from Open Seat. We suggest you:

  • Meet at the restaurant, and get there and home on your own.
  • Share your plan with someone you trust, and use the check-in during your meal.
  • Leave whenever you feel uncomfortable. You don't owe anyone your time.
  • Call local emergency services (911 in the US) if you're in danger. Open Seat can't respond to emergencies.

Community rules

  • Be who you say you are. No fake profiles, other people's photos, or pretending to be someone else.
  • Say what it's for, and stick to it. Tables are for friends, networking, or open to dating. Don't pursue dating at a table that isn't for it.
  • Be respectful. No harassment, hate, threats, unwanted sexual comments or advances, or pressuring anyone to drink, pay, or leave with you.
  • Show up, or cancel in time. No-shows are recorded, and repeated no-shows limit what your account can do.
  • No selling or scams. No spam, asking for money, promotions, or recruiting people into businesses.
  • Keep other people's information private. Don't post other people's profiles, messages, or plans, and don't use Open Seat to find out where someone is.
  • Nothing illegal, and nothing involving anyone under 18.

Reports, blocks, and enforcement

  • You can report or block anyone at any time. Reports are reviewed.
  • If someone breaks these terms or puts others at risk, we may limit features, remove content, or suspend or close their account, without notice when safety requires it.
  • An account with a report that was acted on, or with three or more no-shows, is restricted: it gets fewer requests and can't join 1-on-1 plans or tables for verified guests.
  • Some safety records are kept after an account is deleted, so deleting and recreating an account can't erase a history of complaints. The Privacy Policy lists exactly what is kept.

Your content

  • You keep ownership of what you add: your profile, photos, messages, and ratings.
  • You give us permission to store it, show it to other people as the app's visibility rules allow, and use it to run Open Seat, for example to compare a photo-check selfie with your profile photos. That permission ends when you delete the content or your account, except for the records described in the Privacy Policy.
  • Ratings of people are private and are never shown to the person rated. Restaurant ratings are shown only as summaries of three or more.

Your account

  • You can sign in with your phone number, Google, or Apple. Keep access to that account secure; you're responsible for what happens under your Open Seat account.
  • You can delete your account at any time in the app. See how account deletion works.

Changes to Open Seat and these terms

  • Open Seat is new. We may add, change, or stop features, and we may pause the service.
  • We'll update these terms as Open Seat changes and change the effective date when we do. If a change is significant, we'll tell you in the app before it applies. Continuing to use Open Seat after that means you accept the new terms.

Disclaimers and limits of liability

  • To the fullest extent the law allows, Open Seat is provided "as is", without warranties of any kind.
  • We aren't responsible for the conduct of other users or restaurants, on or off Open Seat, or for restaurant information that turns out to be wrong.
  • To the fullest extent the law allows, our total liability to you for any claim about Open Seat is limited to the greater of the amount you paid us in the 12 months before the claim, or US $100. Open Seat is currently free.
  • Some places don't allow these limits, so they may not apply to you.

Disputes

These terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law rules.
